9. Spanc agents' right to interfere
Article L. 1331-11 of the French Public Health Code establishes the right of Spanc agents to enter private property to carry out inspections.
This article specifies that, in the event of an obstacle to the performance of inspection tasks, the occupier is required to pay a sum at least equivalent to the fee charged by the municipality for the Spanc service; this sum may be increased by a proportion set by the municipal council, up to a maximum of 100%.
However, article 7 of the decree of September 7, 2009, relating to the terms and conditions for carrying out inspections of non-collective sanitation installations, specifies that access to private property must be preceded by a notice of inspection sent to the building owner and, where applicable, the occupant, within a period specified in the regulations of the public non-collective sanitation...
