3. Conditions for the use of partnership contracts

Note

Generally speaking, and with the exception of a few specific points, it should be noted that the provisions governing partnership contracts for the State and its public establishments and those for local authorities and their public establishments are virtually identical.

3.1 Substantive conditions

Before 2015, public purchasers could use three alternative criteria to award partnership contracts: urgency, complexity or efficiency (efficiency being characterized by a more favorable benefit/disadvantage balance than a conventional contract).

Since 2015, after ten years of partnership contract practice, the legal framework for using this type of contract has been clarified.
