According to Article 1246 of the French Civil Code, "any person liable for environmental damage is required to compensate for it". In order to understand corporate environmental liability, we need to look first at the conditions under which it applies, then at the admissibility of actions for reparation, and finally at the effects of such liability.

1.1 Conditions of use

Three conditions are required: ecological damage, a triggering event and a causal link between the event and the damage. It is up to those bringing a civil liability action for compensation for ecological damage to prove these elements. If such proof is established, the claim is considered well-founded.
