3. Criminal liability
Employers may be held criminally liable for breaches of health and safety regulations. Its purpose is to punish offences. It must be distinguished from civil liability, which is designed to compensate the victim for the damage suffered.
When it comes to occupational health and safety, criminal liability may be incurred under the French Labor Code or the French Penal Code.
3.1 On the basis of the Labour Code
In the event of a violation of a health and safety rule set out in the French Labor Code, the offender will be held liable on the basis of the Code.
