2. Placing on the market of new ESPs subject to Directive 97/23/EC and then 2014/68/EU

Following a transitional period (from November 29, 1999 to May 29, 2002) during which ESPs manufactured under the old regulations could be placed on the market, the Decree of December 13, 1999, supplemented by the Order of December 21, 1999, transposing Directive 97/23/EC, became the new regulatory reference, until it was repealed to transpose Directive 2014/68/EU, now the regulatory reference.

In what follows, the reference DESP will be used to refer to directive 2014/68/EU.

The design of ESPs will take into account ICPE requirements and other specific applicable legislation (e.g. under slope tanks for the storage of liquefied flammable gases).
