Non-performance of the contract alone is not sufficient to establish contractual liability. There must also be damage and a causal link between this damage and the failure of the contractual partner.

Damage can be moral, material or physical. Material damage covers not only material losses, but also lost earnings (e.g. the proceeds from the sale of goods).
