4. Sanctions

KEY FACTS

As of November 8, 2002, failure by an employer to transcribe or update the results of a risk assessment will be punishable by a fine of €1,500 (€3,000 in the event of a repeat offence).

Failure to make the document available to employee representatives or the labor inspectorate is also punishable by law.

Employers who fail to produce a single document are subject to a wide range of sanctions. It is also important to note that the legal entity may be held liable under the conditions set out in Article L.121-2 of the French Penal Code. In this case, the penalty is quintupled.
