9. Backup procedures and ATEX groups
9.1 Backup procedure
Like all New Approach directives, Directive 2014/34/EU contains a safeguard procedure that allows Member States to take all necessary measures to withdraw a product from the market or restrict its free circulation. In particular when the Member State considers that the product bearing the CE mark, although used in accordance with its intended use, may endanger the safety of people, domestic animals and property. Such measures may be taken if the product does not comply with the essential requirements, if a standard has not been correctly applied, or if the standard is directly involved.
