2. Odors and waste legislation

The law of July 15, 1975 on waste disposal and materials recovery is the basic text of waste regulations. This text has been amended several times since 1975, and its provisions have been incorporated into the Environment Code.

Two articles contribute to the prevention of odour nuisance:

  • Article L. 541-2 of the French Environment Code establishes the principle that "All producers or holders of waste are required to manage it or have it managed [...]. Any producer or holder of waste is responsible for the management of such waste until its final disposal or recovery, even when the waste is transferred to a third party for treatment";
