6. Alternative dispute resolution
Often, rather than resorting to conventional procedures, other means are sought and used to settle a conflict or dispute. These are known as ADR or ADRL. (Alternative Dispute Resolution, or ADR), thus avoiding litigation and relieving the pressure on the courts, which is becoming increasingly necessary in France.
As such, we will examine :
arbitration ;
conciliation and mediation.
6.1 Arbitration
This is a procedure for settling disputes by an "arbitral" tribunal made up of one or more private individuals in an odd number known as "arbitrators".
