8. Conclusion

Criminal risk is a recurrent theme in the work of maintenance managers, and there is no shortage of cases before the courts.

However, with common sense and a few principles, the risk can be considerably reduced:

  • act in proportion to its means (unlike the employer, who is subject to an obligation of safety of result);

  • do not try to solve your safety problem alone, but refer to the CHSCT when there is a danger in the company;

  • regardless of legal requirements, you must always be concerned about the safety of others;

  • think safety for the average person;

  • preserving the evidence: we always draw up a written risk prevention plan according to the level of accident risk (5-page document or small sheet)....
