7. The importance of prevention
Increasingly, it's important not just to manage disputes as best we can, but to think upstream, not just about the best way to settle disputes, but about how to prevent different types of risk and dispute.
One of these stems from the multiplication of different types of standards and the rise of soft law. We'll look at a few aspects of this, but monitoring and prevention must be a general and widespread attitude in all areas of corporate strategy, as everything is potentially fraught with risk, and therefore liable to litigation or prosecution by state or regional authorities.
